Learned counsel on behalf of the petitioner filed an application seeking withdrawal of the case on the ground stated in their petition seeking liberty to file a fresh case.

Learned counsel on behalf of the OP is present. who already submits written objection challenging the maintainability of present case.

Since the petitioner likes to withdraw the case, prayer is allowed. But regarding liberty to file a fresh case it is hereby ordered that the petitioner shall pay a cost of Rs. 1000/- to the OP in case of his filing a fresh case.

Thus the instant case is disposed of on withdrawal.
