VYAS, MEMBER The gist of the complaint is that the complainant booked an article through speed post with acknowledgement due with Post Transaction number ED 404206451 IN on 13/8/14 from Inderprastha Head Post Office to be delivered to Central Information Commissioner Old JNU Campus, New Delhi and paid Rs 28/- to the OP.For the said speed post she paid extra amount for proof of delivery(POD).She made several communications to the OP to get the proof of delivery but all in vain, rather OP tried to mislead the complainant and gave wrong information through letter dtd. 13/11/14 and did not supply the ?acknowledgement due? to the complainant though mentioned therein that the POD is being supplied. It is stated that the complainant suffered a lot of harassment physical, mentaland also economical loss on account of the deficiency in service on the part of the OP being liable to supply the ?Acknowledgement due? to the complainant since the money was charged for it.The complainant served legal notice dated 12/7/15 to the OP.Following prayer has been made :- ?To direct the opposite party to pay Rs 2,00,000/- for mental agony and physical harassment meet out to the complainant due to deficiency in service on the part of the opposite party, Further to pay Rs 30,000/- as the litigation charges to the complainant. Any other relief which the Hon?ble Forum deem fit and proper may also be passed in favour of the complainant and against the opposite party in the interest of justice.? The complainant has filed some documents with the complaint including the copy of receipt in respect of the speed postletter dated 13/8/14 and the letter of the OP dated 16/10/14 addressed to the complainant. The OP filed version/written statement stating that the speed post article booked on 13/8/14 by the complainant was delivered to the addressee on 16/8/14 and the intimation letter dated 16/10/14along with special delivery slip was given to the complainant by senior post master Krishna Nagar Head Post Office on being asked by complainant vide her letter dt. 29/8/14.Again the copy of letter dtd. 1/12/14 was sent to the complainant which was received from the JNU post office. Copies of said documents also filed by the OP. The complainant did not file the rejoinder, however filed evidence by way of affidavit affirming the text of the complaint.The OP also filed its evidence reiterating the contentions made in the version and relied on the documents filed. Both the parties have addressed oral arguments.We have considered the material placed before us and the arguments along with relevant provisions of law.The undisputed facts are that the complainant booked an article to be sent by speed post mode and made the payment for the same.The receipt issued by the postal authorities in token of said booking shows on its top ?SP POD INDRAPRASTHA HEAD POST OFFICE?.The letter dated 16/10/14 is also not disputed by both the parties. The issue wrangled during the argumentsby the complainant is that the ?Acknowledgement Due? was not supplied by the OPdespite demand which is gross deficiency in service and as a consequence thereof she suffered loss, however, the alleged loss though quantified as Rs. 2,00,000/-is neither substantiated in the complaint or in the evidence affidavit.The OP during the course of arguments pointed out that the Proof of Delivery was given to the complainant through letter dated 16/10/14 on her request and as such there is no deficiency in service on their part.It is further stated that NO acknowledgement due is attached with the speed post articles for the signatures of the addressee against its receipt as in the case of registered A/D booking and therefore, the question of giving the acknowledgement due to the complainant does not arise.It is however stated that the proof of delivery was supplied to the complainant on 16/10/14 for which some charges were taken at the time of booking of the speed post article so the complaint is liable to be dismissed.Further it is stated that the information regarding the delivery can be tracked on the web site of India Post which the complainant can access. In the facts & circumstances of the case on record, it is clear that the OP booked the article for speed post delivery and also charged for the proof of delivery which is obligatory on the part of OP to supply to the complainant within a reasonable time at its own which has not been done. In this case, the complainant approached the OP for the proof of delivery/ acknowledgement due through letter dated 29/8/14 and thereafter too OP admittedly took more than one and a half month to intimate the complainant of the delivery report through letter dated 14/10/14 which tantamount to be deficiency in service on the part of the OP.The argument that the delivery report can be tracked on the web site does not absolve the OP?s liability to providethe proof of deliveryto the complainant.WE therefore, hold the OP liable for deficiency in service. The complainant though claimed Rs. 2 lac for mental agony & physical harassment but has failed to substantiate the amount claimed by her and failed to quantify the amount in the specific heads of harassment. We therefore, award a sum of Rs 2500/- as compensation beside litigation cost of Rs. 500/- to be paid by OP to the complainant within 30 days from the date of receipt of this order failing which action under section 25 & 27 of the Consumer Protection Act 1986 can be initiated by the complainant.The complaint is disposed off accordingly.
