Axis bank mumbai - Wrong billing and excess debit by Axis bank against Credit Card
Vipul Chandra Singh filed complaint against Axis bank mumbai on Mar 26, 2021
I am an existing customer of Axis Bank for last several years. I am using Neo Credit Card of Axis Bank and making regular payment of my dues on or before due date regularly.
With reference to above captioned complaint number *************** dated *th Dec **** (Copy of system generated complaint attached as Annexure-I), I would like to put forward few facts before your honourable office.
I have taken Neo Credit card (CC) bearing number ********** **** of Axis Bank with credit limit of *.**L. As per CC statement of Feb ****, I was having available credit limit of Rs. **,***.** (detailed CC statement of Feb **** is enclosed at Annexure – II) with total outstanding of Rs. ******.**. My mother-in-law was admitted in Reliance Hospital, Koperkharne, Navi Mumbai in month of Feb and was supposed to get discharged on **th Feb ****. Due to limited credit limit available, I called customer care centre of Bank on **th Feb **** asking about enhance credit limit (same can be verified through call records of bank) but they refused saying on my card (NEO) they can’t increase the limit there are only two ways to do it.
*. By applying for new card *. By repaying the pending amount
When enquired, what could be alternative, they suggested that Axis bank can provide instant loan to my savings account as per my requirement and from there I can utilize the same for my credit card. If i will return the amount within * month, there will be no foreclosure charges or applicable GST on it.
I agreed for an instant loan and Rs. *,**,***/- was transferred to my savings account of Axis Bank (************) on **th Feb ****. (Bank statement is enclosed at Annexure -III) Out of the money received (Rs.*.**L) I paid the due amount Rs. **,***/- on **th Feb **** at Reliance Hospital and hence my transaction was approved. Still bank has levied extra charges of Rs. ***/- for the same.
Along with my Credit card outstanding of Feb **** I have paid Rs. ****** (CC outstanding of ****** and *,**,*** of loan amount) to CC account on **th Feb **** through my Axis bank account. (CC statement confirming the same is enclosed at Annexure – IV).
Before making the payment on **th March ****, I called CCE and enquired about process for closing the loan. CCE explained that either I can make direct payment to CC account or he will generate closure request and can make payment. When I asked which one will be faster, he confirmed that I can go ahead and make the payment from my CC account. I also told that I have consumed only **,***/- from loan amount balance amount of **,***/- bank can take directly from my saving account. But he confirmed that I need to pay whole amount of *,**,***/- consumed and unconsumed as bank can’t debit from my savings account. Same can be verified from call recordings of **th Feb ****
Again, in month of march I have paid **,*** (******) on *nd March and Rs. *****.** on **th March (mistakenly against my March CC bill even though amount of *****.** was showing as Cr. On the day of making the payment of Rs. *.**L, I have spoken to CCE and he confirmed that I can make the payment directly to CC account and he will generate loan closure request.
To my surprise when I spoke to CCE on **st April , I have been told that loan closure request have been generated but due to insufficient balance on my saving accounts the request has been rejected and I have to pay the EMI of CC.
I have registered a complaint (********* dated **st April, post my discussion with Mr. Wasim, L* of Customer care) regarding closure of my loan ( availed on **th Feb **** of amount *,**,***) reversal of EMI, GST and re-adjustment of statement. I have been informed by Mr. Wasim that within * working days, i should get a mail regarding closure of loan, reversal of EMI, GST etc. when didn't hear anything, I again called CC on *th May **** and spoken to Mr. Manas of CC and reminded that due date of payment for my CC is *th and next bill generation is **th but till date I haven’t received any solution of my query. On *th May I have also raised complaint through Grievance redressal but till date there is no resolution and as per process my next CC bill has also been generated.
This matter has been escalated via support mail id, to Mr. Pankaj Dhage, Mr. Ashish Sharma, Mr. Ravindra Rao as well as to Nodal officer. At last I have escalated the matter to Mr. Amitabh Chaudhry (MD). Mr. Jitesh Makwana (Nodal officer) spoke to me and verified all details based on transactions of CC and savings account (Screenshot of saving bank account regarding receipt of instant loan, payments made to CC accounts in month of Feb and March, CC statement is enclosed for your ready reference in another word document) and confirmed that I will generate a SR (*********) for cancelling of loan account of *,**,***/- as you have already paid and initiate refund of EMI charges and GST. To my surprise I have got a bill stating that I still owe to pay more than **,***/- to Axis Bank after so called refund of EMI, cancelling of loan and applicable GST.
MY simple grievance is:
• If I have already paid the instant loan of *.**L still I need to re-pay just because of ill information from CCE.
• What about extra payment of *****/- and *****/-
Over and again I have raised the issue with Nodal officer, Principal nodal officer, MD but every time they have added the amount of Rs. **,***/- as Debit (Dr.) while calculating the dues. Post raising my complaint with your RBI ombudsmen, Principle Nodal officer mailed the calculation again talking about repeat debit of **,***/-. I have made additional transactions on **th Feb **** which cant be possible without instant loan availed.
Over and above Rs. **** (minimum due amount of latest bill) has been auto debited from my Axis bank account on *th Dec ****.
As a last hope, I am writing this mail to you for early resolution. I am getting reminder calls from recovery officer of Axis bank which is mental harassment. As per fresh CC statement, I need to pay more than **,***/- to Axis bank.
I have also raised complaint to RBI ombudsman (Mumbai I) on *th Dec **** (compliant no. ***************) which was closed on **th March **** under action clause **(*)(a) without any chance given to plaintiff . When enquired with RBI Ombudsmen on **th March ****, they confirmed that appeal to said complaint can't be made and can move further with next available legal remedy. IN one of the mails from MD office plaintiff was intimated regarding dire consequences.
May I request your hon’ble office to issue maintain status quo as on Oct **** regarding CC statement till final judgement is passed from your hon’ble office as i am continuously getting calls/ reminders and collection executive have visited residence of plaintiff which is very disturbing and causing mental agony.
Thanking you!!
Yours faithfully
