Decore Design SKSM Enterprises - Unfinished Interiors Kitchen and Cupboard

Facts of the Case:
a. The Complainant purchased a flat in Purva Zenium, Bangalore and, in October ****, engaged the Opposite Parties for execution of interior works based on their representations and prior projects.
b. On ** November ****, Opposite Party No. * issued a quotation. After further design discussions, the final amount was fixed at ₹ *,**,***/- on ** November ****, with an assurance that work would be completed within ** days (by January ****).
c. The Complainant made payments as follows:
o ₹ **,*** on **.**.**** (to SKSM Enterprises)
o ₹ **,*** on **.**.**** (to SKSM Enterprises)
o ₹ **,*** on **.**.**** (to SKSM Enterprises)
o ₹ **,*** paid directly to vendors for tiles/quartz materials (May–June ****)
Total Paid = ₹ *,**,***/-
d. Despite repeated follow-ups, work did not begin until May ****, a delay of more than six months.
e. The work commenced partially but remained incomplete. On ** June ****, the Complainant inspected the site and shared a detailed list of pending items with the Opposite Parties. Even by ** August ****, the project was still unfinished.
f. A Legal Notice was issued to Opposite Parties on ** August ****, yet no response no remedial action was taken by them to complete and deliver the remaining work.
*. Deficiency in Service & Unfair Trade Practice:
The Opposite Parties failed to complete the agreed work within time, left major portions incomplete, and ignored repeated requests. Such conduct amounts
o Deficiency in Service under Section *(**) of the Consumer Protection Act, ****.
o Unfair Trade Practice under Section *(**) of the Act, by misrepresenting timely delivery and failing to honor commitments.
o Breach of Contract and Trust, causing financial and mental harassment to the Complainant.
*. Cause of Action:
The cause of action first arose on ** November **** (agreement date), continued through subsequent payments and non-performance, and is still subsisting. A legal notice was issued to Opposite Parties on ** August **** but they took no remedial action.
