POWER WELFARE SOCIETY - Unauthorized illegal stilt area construction

We bought the flat in ****. We were given to understand that the property has all approvals in place. Later on, we came to know that fire clearances were denied and occupation certificate for one block has been stopped due to illegal stilt area constructions. HMDA has issued an order in May ****, asking the Society to put an end to stilt area construction activity and removal of commercial establishments. The executive body got dissolved in a recently held GB Meeting and a new temporary executive body (TEB) has been nominated to temporarily look after the affairs of society. TEB has gone one step ahead and despite warnings from concerned senior citizens like me, and started converting stilt areas in respective blocks (starting initially in D block, to be followed with similar construction in E block and F block seriously impacting the peaceful life of residents living in respective lower block owners) taking the plea that the space would be used for social/cultural/religious activities of various kinds. In the original building plan submitted and approved by HMDA, all such activities have to be conducted in earmarked spaces allotted in the clubhouse. The clubhouse has got permission for * floors, whereas the existing skeleton structure has been raised up to * floors, showing scant regard and respect for the rule book.
The stilt areas in other blocks have been illegally allotted to commercial units such as playschool, pharmacy, saloon, canteen, grocery store, etc. The previous executive body tried its level best to get these unit owners to respond to its request to vacate the stilt area. However, the commercial unit owners along with the playschool have gone to the Court and a kind of impasse has been created. Agitated residents have filed court cases and at present ** such court cases are pending, apart from an arbitration case filed by Shri Ajaya Nathani alleging malpractices and inappropriate use of funds by the executive body headed by the then paid Chief Executive Officer(has been removed by the previous executive body as things stand now).
In a * acre complex already *** flats have been constructed with very little room for children to play and enjoy. The walking strips are full of hurdles everywhere. The approach lanes to each block have been covered with concrete plastering. The Fire department has objected to these constructions and held up clearances for the past several months. Occupation Certificate for C* block has been withheld by HMDA citing stilt area construction and illegal occupation of commercial units.
Instead of clearing the mess, the TEB is trying to add fuel to the fire by going for additional stilt area construction activity under the guise of social/cultural purposes of various kinds. Life has become very suffocating especially for senior citizens like me who have moved into the apartment expecting peaceful, harmonious, pleasant living. Unable to bear with such illegal construction activity going around the whole year, I have placed the request before the TEB three times, but to no effect.
I have tried my level best to arrest this menace. I have placed the complaint before HMDA repeatedly, but they seem to ignore the complaint. With two granddaughters (aged * and * year) the noise levels from encircled and closed stilt area space –even if utilized for music, dance programs, carom, table tennis, & other indoor games of various kinds plus regular religious functions etc—would seriously hamper our peaceful living if my first-floor apartment. After exhausting all available options, I have decided to seek help from the Consumer Court seeking justice. Because of the pending court cases and continuous infighting between warring groups, the property prices have crashed. I have placed the flat for sale but there are no buyers for the same even when offered with a steep discount. The price per sq feet in and around PWS quote at Rs. **** upwards and there are no buyers for the flat even when offered at Rs. **** per square feet, causing incalculable emotional pain apart from the notioanl financial loss that we had to swallow silently.
I would request the Consumer Forum to intervene, arrest the stilt area constructions immediately, ensuring compliance with the rule book so that agitated and concerned senior citizens living in the society breathe easily and lead a peaceful, retired life full of harmony and happiness.
