Respected sir,
This is to seek your valuable help with respect to a rental-security-deposit refund issue from a Bengaluru based rental company which was operating in Wagholi, Pune.
BrightPath Technology and Services Pvt. Ltd, was operating a paying guest and lodging services in Aura County society in Wagholi, Pune.
My friend (Anupam Kocher) and I (Pranav Kumar Singh), entered into an ** months agreement with the company for our stay in flat ***-F in the society in the month of March'**. We paid INR **,*** as a security deposit and have been regularly paying INR **,*** per month for staying in the flat, since March'**. From Oct'** onward, the company stopped its operations from the society and handed over the operations to the builder. However, the company denied to pay us the security deposit back, neither did they return the security deposit to the builder, whom they transferred the operations to.
We vacated the property on **th Oct after paying Oct rent and electricity bill, as we have been working from hometown due to Covid-** issues. Hence, we would like to get our security deposit back from the company
Facts, Dates and Amounts:
*) **rd Feb'**: Pranav and Anupam booked a rental property with Rentmystay in Aura County Society, Pune.
*) *st Mar'**: They paid the security deposit of Rs **,*** ,*st month rent Rs **,*** and entered into ** months rent agreement with Rentmystay
*) *st Mar'** - **th May'**: They stayed in the flat and paid all rents on time (Rs **,*** per month)
*) **th May'**: They vacated the flat and left to their hometowns due to pandemic situation in Pune
*) *st June'** - **th Aug'**: They paid full rent for * months despite not staying in the flat
*) **th Sep'**: They paid only Rs **,*** as Sep rent, as caretaker (Vishal) informed that Rentmystay is going to stop its operations in the society shortly.
*) *th Oct'**: Rentmystay sent official email to all the tenants about closing their operations in the society, asked tenants to clear their pending dues with them and informed to pay subsequent rents directly to the builder of the society. Rentmystay also mentioned that the tenants' security deposits would be with the builder/owner from that day.
*) *th Oct'**: Builder denied about any security deposit transfer from Rentmystay, which Rentmystay put on the mail and asked tenants to approach Rentmystay team for all the returns.
*) **th Oct'**: Pranav and Anupam vacated the property and paid full Oct rent to the builder and also paid for the electricity bills.
**) **st Oct: Rentmystay sent again an email to all the tenants mentioning they were yet to receive settlement from the builder/owner for the furniture they have in the flats worth Rs **.** lakhs. They suggested tenants to compensate for their security deposits by deducting the amount from the rentals paid to the builder.
**) *rd Nov'**: Builder sent email to Rentmystay asking to refund Tenants' deposit and advised not to misguide tenants. Rentmystay didn't provide any satisfactory response for the mail till now
**) **th Jan'**: Legal notice was sent to Rentmystay team asking to refund the amount within next * days else case filing would happen
**) **th Jan'**: Rentmystay asked to share the list of transactions made with them from start of stay (March'**)
**) **th Jan'**: We shared the list along with Oct month clearance paid to the owner and electricity bills paid while vacating the flat on **th Oct'**
**) **st Jan'**: Rentmystay replied that they need to deduct Oct rent and * days of Nov rent, despite they stopped operations from society in Sep'**. And hence, they would pay back only Rs ****.** instead of Rs **,***
**) **nd Jan'**: We asked Rentmystay the logic of asking for Oct rent and * days of Nov rent when they stopped their operations from the society in Sep'** itself.
**) **rd Jan'**: Rentmystay replied that we should ask owner/builder for the refund, whom they transferred the operations post Sep'**.
**) **th Jan'**: We asked Rentmystay pay us back the security deposit directly as rent agreement was between us (tenants) and them (Licensor), on which they haven't replied so far
