VP broadband - Rent not received for purchasing

I had purchased storage capacity (TB) from the Opposite Party — VP Broadband Abacus — as part of their data centre investment/rental plan in Oct ****.

I had duly paid the required amount along with applicable GST, which was duly deducted and deposited by the Opposite Party.

The Opposite Party had assured regular rental income . Initially, rent was being paid as per schedule.

However, from May. ****, the Opposite Party stopped paying rent without any prior notice or justification.

Upon repeated follow-ups, the Opposite Party accepted a buyback request for the said asset, assuring I will get the refund and it would be processed shortly.

Despite acceptance of the buyback, the Opposite Party failed to refund the investment amount, and no clear timeline or written confirmation has been provided.

I made multiple attempts through emails, calls, and other means to obtain resolution, but the Opposite Party did not act in good faith or respond appropriately.

I humbly prays that this Hon’ble Commission may be pleased to:

Direct the Opposite Party to refund the entire investment/buyback amount

Direct the Opposite Party to pay pending rent dues up to the date of refund.
