Spectacle Vision Eye Care - Refusal to exchange Spectacle frame

I purchased a spectacle frame from the retailer “Spectacle” in Vashi, Navi Mumbai on **-Oct-****. When I wore the frame for a bit longer at home later, I found it to be uncomfortable, not a good fit and unsuitable for my face. Since I have high eye power (myopia) and presbyopia, I need to wear glasses all day and require a good fit. I went back to “Spectacle” on **-Nov-**** and asked for an exchange; I provided the frame undamaged and in original condition. The seller refused to accept the return stating that the return period is only *-* days after purchase. When I told the seller that I would file a complaint, he told me to go ahead saying that the receipt clearly states that items once sold are not returnable. I filed a complaint on National Consumer Helpline on **-Nov-****, but the company did not respond despite multiple reminders. I believe that the seller is in violation of consumer rights, and I am seeking a full refund on the following grounds which are to the best of my knowledge:
*) The seller’s refusal to not accept the return is against the Consumer Protection Act of **** which establishes refusal to refund within ** days of purchase as unfair trade practice.
*) The receipt has this printed: “Please note articles sold under this cash memo are not returnable and will not be taken back under any circumstances”. The Department of Consumer Affairs has prohibited printing this condition on receipts and labels this as unfair trade practice.
