Subject: Legal Notice for Refund of LOI Amount, Interest, and Compensation – Deficiency of Service & Unfair Trade Practice

Dear Sir(s),

I, Abubakar M, S/o Havaldar M.D., hereby issue this legal notice in connection with the amount of ₹*,**,*** (Rupees One Lakh only) paid by me towards the Letter of Intent (LOI) for obtaining a Fabrico Dry Cleaning franchise at Kokapet, Hyderabad, in March ****.

*. Background

In March ****, I intended to take a franchise of your business and planned the same in partnership with a friend. Based on mutual understanding, I paid the LOI amount as an initial commitment.

However, within one week of making the payment, my partner unexpectedly withdrew from the arrangement. It is pertinent to note that although I paid the LOI amount, I did not sign any physical agreement or final franchise contract accepting the terms of the LOI.

I immediately informed Mr. Abhishek Kansal regarding my inability to proceed.

*. Assurance and Efforts Made

As per your policy, I was informed that refund requests must be made within ** days. Being aware of this, I requested Mr. Abhishek Kansal to allow flexibility or an unconditional extension, assuring him that I would make sincere efforts to arrange an alternative investor.

Based on his verbal assurance, I approached multiple investors, presented the business model, and explored financial options including applying for a business loan. Despite genuine efforts, I was unable to secure an investor.

*. Refund Request and Non-Response

Upon failure to proceed, I formally requested a refund. Initially, Mr. Abhishek Kansal stated that he would check internally and assist me. However, thereafter:

He stopped responding to messages
Avoided communication
Disconnected calls
Completely ignored further follow-ups
*. Escalation to Management

I escalated the matter to senior management:

Mr. Bhupender did not respond to any calls or messages.
Mr. Jibran Hyder initially responded and assured via message that the refund would be processed within one week (proof attached).

Despite this assurance, no refund was processed. Subsequently, even Mr. Jibran Hyder became unresponsive.

*. Additional Concern

During this period, the Kokapet franchise location was allotted to another party without any prior intimation to me. This reflects lack of transparency and fair business conduct.

*. Financial and Mental Impact

The amount of ₹*,**,*** paid by me is not a small sum. It represents my hard-earned money. Despite clearly communicating my inability to proceed, your company has failed to refund the amount.

I was forced into repeated follow-ups, resulting in:

Mental harassment and stress
Financial loss
Legal expenses
*. Legal Position

Your actions amount to:

Deficiency in service
Unfair trade practice
Prima facie unethical and misleading conduct
*. Relief Sought

I hereby demand:

Refund of ₹*,**,***
Interest from ** March **** till realization
Compensation of ₹*,**,*** for harassment and loss
Reimbursement of legal and incidental expenses

You are hereby called upon to comply within ** days from receipt of this notice.

Failing which, I shall initiate legal proceedings before the Consumer Forum and other competent authorities at your risk, cost, and consequences.
