Winspark Innovations Learning Pvt Ltd Planetspark - REFUND AND CLOSURE OF LOAN

I have enrolled for my daughter for Public Speaking & Creative Writing (Advanced) course with Winspark Innovations Learning Pvt Ltd (Planetspark) on **-**-**** and paid Rs. **,***/ - towards course fee (Rs. *,*** was paid via Phone pe and Rs. **,***/- loan from FIBE, which was arranged by Planetspark instantly at the time of enrollment). However, even after completion of ** classes, I found no improvement in my daughter’s English speaking skills or communication skills, hence I decided to opt out of the Public Speaking & Creative Writing (Advanced) course to save my hard earned money. As such I have sent emails to Planetspark on **.**.****, **.**.****, **.**.****, **.**.**** & **.**.**** regarding opting out of the above course and requested to refund me the excess amount that I have paid after deducting the amount to be paid for the classes availed and to close my loan with FIBE immediately (since the loan with FIBE was arranged by Planetspark). But, Planetspark refused to refund the amount and to close the loan and replied that as I have consumed ** classes and as per their policy, if I have consumed * or more than * classes which fall under non-refundable enrollment and they cannot refund the amount. However, in the Terms & Conditions provided by planetspark at the time of enrollment of my daughter to Planetspark course, above condition i.e. “if consumed * or more than * classes, it falls under non-refundable enrollment and the amount cannot be refunded” was not mentioned and instead it was mentioned that if I opted out before availing of ** classes or less, per class charge would be Rs.***/- and in order to close the loan taken for the Planetspark course, I must ensure to pay the fee as per the class consumption. Hence, as per the above conditions, I am eligible for Opting out of the Plantspark course and as such for the refund of the excess fee paid and for closure of my loan with FIBE. Further, after I sent mail regarding opting out of Planetspark course, representatives of Planetspark contacted me and offered for change of Teacher/curriculum, however, I am not agreed for the same and requested to process for refund & closure of loan as I have opted out of the Planetspark course, but they refused refund and closure of loan. By joining Planetspark course, I have already wasted some money and I don’t want to waste my money further, hence, not agreed to continue with the course. Though, three months passed after intimation about opting out of the course, Planetspark did not refund me the excess amount that I have paid and did not closed my loan with FIBE.
