Provident Housing Limited - Recovery of Interest Compensation on Refund of Amount paid to Provident Housing Ltd

I had booked a *BHK Apartment *C-**** in Provident Housing Ltd Project Skyworth at Mangalore, Karnataka in Sept **** by paying booking amount of Rs * Lac. Based on the demand made by the builder Slab wise payment by way of self funding and ICICI Bank Loan, the total amount including booking amount Rs **.** Lacs was done. The project was not registered under RERA at the time of booking and the completion date as per the stamped and signed agreement is Dec ****. I was following up by various emails to their crm and also Ashish Puravankara , Managing Director till September **** with respect to the Completion and possession of the apartment. I also visited the project site and found that the structure of the building was ready and was told that my apartment is registered under RERA as Phase II and your apartment will be handed over by Sept ****.

I wrote to them that this is enormous delay and the agreement clearly states Dec **** and I have been interest on my ICICI Bank loan , loss of rental income and tax benefit and benefit of capital appreciation.

On a date in October ****, Provident Housing Ltd without any initimation or covering letter, sent two cheques by courier to ICICI Bank Manglore and my Mumbai residential address two cheques totalling to Rs **.** Lacs . This amount is same as the total amount paid to the Builder till date.

This total amount was received and deposited by me in Oct **** and the total amoun was credited to my Bank Account.

I am claiming interest @ **% pa on this refund amount of Rs **,** Lacs from Sept **** to Oct **** which comes to Rs ** Lacs. Sine, there is no positive response on this interest on the refund made, I have calculated interest on this Interest amount of Rs ** lacs and now the total refund of interest amount comes to Rs ** Lacs as on Nov **,****.

I have communicated to their company secretary, CRM and the two directors of Provident Housing Ltd that no further amount is payable beyond the refund of Rs **.** Lacs (Prinicipal amount)

I am seeking legal action for recovery of the Interest upto Nov **, **** of Rs ** Lacs , Compensation for Mental agony and deficiency in service of Rs * Lacs and Litigation costs of Rs * lacs. This total amount comes to Rs ** Lacs.
