Background of the Case:
On August **, ****, I, Ajay Agrawal, made a purchase amounting to ₹*,*** from Max Protein using the services of CashKaro, a cashback and coupon provider. The transaction, carried out through CashKaro's platform, was tracked as Order ID: RBMP*****. According to CashKaro's terms and conditions under Clause * - Cashback Conditions, I was eligible to receive a ₹*** cashback on this purchase, provided the transaction met all necessary criteria.
The purchase was made in good faith, adhering to all the platform's terms, without any indication that it would be ineligible for cashback. All parameters of the transaction were satisfied, making it a valid and tracked transaction, as defined by CashKaro’s terms.
Issue at Hand:
Despite fulfilling all requirements, the promised ₹*** cashback has not been credited to my account. There has been no communication from CashKaro about any technical errors or tracking issues that could have impacted the crediting of the cashback. Repeated attempts to resolve the matter directly with the company have resulted in no resolution. This lack of transparency and failure to fulfill their contractual obligations led me to pursue a formal complaint.
Violation of Consumer Rights:
CashKaro's failure to credit the cashback is a clear breach of contract, as outlined in their own terms and conditions, and a violation of my rights as a consumer. According to the Consumer Protection Act, ****, any breach of contract by a service provider where the consumer is unfairly deprived of their entitled benefits can be considered unfair trade practice.
Furthermore, CashKaro has not provided any recourse or clarification regarding the issue, which falls under deficiency in service, as per Section *(**) of the Consumer Protection Act. The company has also failed to exercise transparency, breaching the fundamental principle of consumer trust.
Legal Grounds for Filing the Complaint:
Breach of Contract: Under the terms agreed upon, CashKaro is bound to credit cashback for valid transactions. Their failure to do so violates the agreement entered into when the purchase was made through their platform.
Unfair Trade Practice: The non-crediting of the cashback despite eligibility, and failure to communicate or rectify the issue, falls under Section *(**) of the Consumer Protection Act, which defines unfair trade practices as deceptive methods by a company that harms the consumer.
Deficiency in Service: CashKaro's failure to provide the agreed-upon service — in this case, crediting the cashback — violates Section *(**) of the Consumer Protection Act, ****. This section outlines deficiency in service as any fault or imperfection that fails to meet the service standard promised by the provider.
Mental Agony and Financial Loss: The unjust withholding of ₹*** cashback has caused not only a financial loss but also considerable mental stress and inconvenience as I have made multiple attempts to resolve the matter directly, to no avail.
Relief Sought:
In light of the above facts, I respectfully request the Consumer Disputes Redressal Commission to consider the following relief:
Immediate credit of the ₹*** cashback to my account.
Compensation of ₹**,*** for mental agony, harassment, and inconvenience caused due to CashKaro’s negligence.
Legal Costs incurred in pursuing this matter, including court fees, advocate fees, and other necessary expenses.
An official apology from CashKaro for their failure to honor the agreement, ensuring that no other consumers are similarly affected.
Conclusion:
This complaint is not just about recovering a small cashback amount, but about holding a company accountable for its failure to honor commitments made to its customers. If left unchecked, such practices set a dangerous precedent for online platforms, enabling them to act without fear of legal consequences. I have approached this esteemed court as my last recourse, trusting in the judiciary's ability to safeguard the rights of consumers and ensure fair and ethical business practices.
