I am writing to formally lodge a complaint regarding the gross deficiency in service and non-payment of consignment proceeds related to two pairs of sneakers consigned with your Mumbai store. Despite repeated follow-ups and confirmed sales, you have failed to release my payouts.
*. Facts of the Case:
• Consignment Date: On *th December ****, I consigned two pairs of sneakers:
◦ Item *: Nike SB Dunk Low Pro Black Gum (Size *.*), assigned MKP *****. Initial price: ₹**,***.
◦ Item *: Adidas Yeezy *** v* Bone (Size **.*), assigned MKP *****. Initial price: ₹**,***.
• Price Revisions:
◦ On *th June ****, the Adidas price was revised to ₹**,*** with mutual agreement.
◦ In July ****, your team requested a price drop for the Nike shoes to ₹*,***. I counter-offered ₹**,***, which remained pending without your response.
• Inventory Retention: On **th April ****, I visited your Mumbai store to collect the Nike sneakers in person. However, your staff persuaded me to leave them, citing high enquiry volume.
• Sale Confirmations:
◦ On **th November ****, your team confirmed the sale of the Adidas sneakers (₹**,***).
◦ On **th August ****, you offered store credit for both shoes, which implicitly confirms that the Nike shoes have also been sold.
• Communication Breakdown: Since **st December ****, you have ceased responding to my emails. WhatsApp communications via (+** *********) have yielded only "fake promises" and vague "one-month" payout extensions, none of which have been honored.
*. Deficiency in Service:
Your failure to process the payout within the industry-standard *–* week window (as per Mainstreet's Seller Policy) constitutes an Unfair Trade Practice and Deficiency in Service under the Consumer Protection Act, ****. Forcing a seller to accept store credit for a sold item is a violation of the consignment agreement.
*. Demands for Resolution:
I hereby demand the following within ** days of this notice:
*. Principal Payout: Unconditional payment of ₹**,*** (₹**,*** for Adidas + ₹**,*** for Nike).
*. Interest: Interest at the rate of **% per annum from the respective dates of sale until the date of actual realization.
*. Compensation: ₹*,**,*** for the mental agony, pain, and harassment suffered over the past two years.
*. Legal Expenses: ₹**,*** (or actuals) toward the cost of legal consultation and notice preparation.
The final email which i received from them says they are processing the payouts of two products confirming two of them sold.
