On *th July **** for this, I have already lodged a complaint at the grievance portal of Consumer Forum and it is “in progress”. The complaint no. *******. This has also been communicated to the organisation – My Flower Tree. Please let me know if there is any other action that I can take.
I had placed an order for cupcakes with certain customization with MyFlowerTree.com on **th June **** to be delivered at the midnight slot (**:** pm to **:** pm) on the same day to an address in Santa Cruz, Mumbai. I had also paid the requisite charges for midnight delivery (in addition to the value of goods) being Rs. ***/-. However, the goods were never delivered at the time and place of delivery. Instead, the company has lied to me stating the following:-
(a) They have attempted delivery but the door was locked and the recipient didn’t respond to their calls. They have also submitted a picture of the main gate from a distance (enclosed below) which can by no means be taken to consider a communication between the security guard and the delivery personnel regarding the door being locked and the non-availability of the recipient at the place of delivery or the fact that the door was locked. In this regard, I would like to mention
(i) That the door wasn’t locked. The images shared by them by no means show that the door of the recipient which is on the **th floor of the building whose main gate’s picture they have clicked from a distance.
(ii) They have not contacted the recipient.
(iii) There has been no communication between the security guard and delivery personnel with regards to the non-availability of the recipient at the place of delivery.
(b) When asked next day over the call as to why wasn’t the sender contacted, if the recipient wasn’t answering the calls (as claimed by them). They told me that the company’s policy is only to call the recipient and not the sender. However, I would like to state that is a blatant lie as I have a mail from them on **th June **** at *:** am bearing the subject “Urgent callback #******” stating that they had tried contacting sender’s number regarding delivery. In this regard, I would like to mention and reiterate that there was no call from them. I also demand a copy of the call logs from their end to prove the contention that they have tried contacting and their calls were not answered. In the meanwhile, when there was no update or communication from them regarding the delivery I have sent numerous messages to them on their Facebook page late night as the sender and recipient were both awake waiting for delivery but there was no reply from them till next morning. After which I have got mail from them citing attempted delivery on their part.
Further to above, while placing my order, as the order required a few customizations (as mentioned above). I was communicating with their online chat assistant named Shradha, who assured me to share a picture of my order when it would be ready but I have not received any pictures from them of my order. A long time before the desired time of delivery, since I had not received any pictures from them I tried communicating with them again through an online chat where their assistant named Robin, denied that no picture would be shared from their end. I had told them then only as to why have they assured that a picture of my order would be shared with me if they are denying it now. I have even mentioned this fact in the numerous messages I have sent to them on their Facebook page but there has been no response in this regard. Since these messages were online chats, I do not have a copy of these communications with me.
I had also told them to redeliver the product for which they were charging Rs.***. I informed that since I have paid all the amount in the starting and once delivery has failed due to false allegations from their end, I am afraid to pay them any amount extra unless my goods are delivered. I had also written to them seeking:-
(a) Redelivery of the product with no extra costs.
(b) Refund of the full amount for failure to provide adequate support. Failure of which would amount to me taking legal action against them.
The value of my order is as follows:-
Cupcake Rs. ****-
Midnight delivery charges Rs. ***/-
Total of Rs. ****/-
The last communication, which I had with them over mail was *st July, **** wherein, to their absurd claims I have mentioned that mere taking of a picture of the main gate from outside, does not substantiate communication between security guard and delivery personnel regarding non-availability of the recipient and the images shared doesn’t show any locked/closed door. I have also asked for a copy of their call logs to prove that they have tried contacting the sender and recipient and the calls were unanswered. It is my humble request, that strict action is taken to blacklist the website as it is clearly fraudulent and earns money by duping innocent customers. Similar complaints have been made by other customers as well and therefore it appears that the company is engaged in fraudulent activity of duping customers. I will be ready to provide any additional support that you require. They have stopped replying to my emails now. I have been duped and I need redressal.
