Hi, this all started when my wife has provided our basic details for a lucky draw contest happened in a mall in Bengaluru, Whitefield. One day, we got a call saying we won a prize in the lucky draw contest and they invited us to a hotel for choosing the prize (* travel voucher/movie tickets/silver coin).
On **th May ****, I have visited Earth hotels (Whitefield). Here only I came to know this is a marketing campaign and LetsGo Holidays Private Limited(LGH) is the company involved. I heard this company for the first time and it is a travel company. They made our family to sit for * hours and listen to their travel packages. They have made many promises verbally. I asked about whether these verbal promises on travel services they made are present in the agreement or not. They have shown me an agreement doc which don't have any of their verbal promises. They said they will send the final agreement later and this is basic agreement which has to be signed now. It is a completely new company to me. On safety side, I have asked them what is their surrender/cancellation policy of the agreement. They have shown me a condition in the agreement which allows the buyer/second party can cancel the agreement within */** days. They will refund the amount back after deducting some **% of the amount as processing charges. Since they have not given enough time to cross-check about the company & their services and they want us to sign the agreement in that meeting itself (including payment done), I thought I can use this condition to cancel the agreement later if things don't work out. Only after checking the surrender condition, I have signed upon agreement with LetsGo Holidays Private Limited(LGH) for a travel membership plan. I have paid *,**,*** INR partial payment ( through my credit card). The total package amount is *,**,***.
I decided to cancel the agreement and informed them well within their cool-off period mentioned in the agreement. Still they are not honoring their own cancellation policy mentioned in the agreement and refunding my amount back.
Some of the reasons for which I have taken this decision for cancelling the agreement:
*)EMI was promised to be no-cost or interest free EMI before signing the agreement. But interest has been levied. The EMI was promised to be **** INR per month. The final EMI amount (principal+interest) is ****.** INR as per the bank amortization schedule.
*)The membership was promised to be all season membership with duration of ** years. But the agreement says it is valid only for * years and applicable only for Blue season which I am not interested in. I didn't receive/sign any final agreement at all having all season membership with ** years duration.
*)There were many other verbal promises made before signing the agreement. These promises are not part of the agreement.
*)After going through detailed google reviews, I feel they are charging a lot for the sub-standard services they are providing. For eg: they promised * star resorts but they are providing basic accommodation which costs around *,*** INR according to google reviews.
I have raised the request for cancellation/surrender of the agreement on **th May, **** through their customer care mail(customercare@letsgoholidays.net). Everyone in the company including their legal team (legalteam@letsgoholidays.net, sandeepraj@letsgoholidays.net, connect@letsgoholidays.net, info@letsgoholidays.net) is included in the mail. Sandeep is the sales guy who have sold the policy to me. Till now(**th July), they have not accepted my request for cancellation of the agreement and not refunding my amount back. Therefore, I have decided to take this up legally.
