Shree Vidhatte Enterprises - Interior Work not completed on time exorbitantly charged substandard material use Mental Harassment

engaged your E*E services for procurement and construction of my flat at * Bungalows. The work was awarded basis commitment that the same shall be delivered within * months. The work started on *th August **** and it was promised that the materials will be used best of quality and hence the cost is high even thought the flat is small. The Site was not handed over on the committed date. The delay continued. I had initially told them that I have to pay EMI and rent both which is very heavy cost for me. The Contractor kept saying you have nothing to worry they will give it. Kept saying the same thing despite not completing the work to allow me to move in. The total delay in ** days which has caused me mental agony, harassment and stress along with me incurring **,*** additional rent for * months (Nov and December) which I had to pay because they delayed in handing over. More importantly basis his commitment i had put in my lease termination hence my landlord had started showing the apartment to prospective tenants. The work kept being postponed and deadlines kept being pushed. When i saw the status of the Site on **th I knew this will not even be completed by **th November ****. Despite put incompetent site incharge who without my permission kept workers over due to which the society members took action against me. Then the BMC did unauthorised access which the incompetent site incharge allowed however, they told me that they continued to work. There was no work stoppage except * days due to building being sealed due to COVID-**. Overall the materials used in the house are sub-standard material and inflated costs have been charged for the same, with them pocketing high margin cuts on each work item with malicious intent to defraud me. Furthermore, they accepted faulty materials (mosquito nets for windows) and installed them after taking an additional **,***/- for the windows over and above the cost quoted in the work order. We reported and they admitted that there is a problem however kept delaying replacing the same thereby breaching the warranty for all material. It's been more than * days and they are not replacing the mosquito under one pretext or another. Even the Windows itself is sub-par material. Windows are critical for my safety. I made all payments as requested I was repeatedly being harassed for payment under the pretext that the materials need to be ordered and work wont progress unless I pay; however, the materials never reached the site on time and apparently they never even paid most of their vendors. Hence, they are liable to be proceeded against for deficiency of services, product defect, criminal breach of trust and breach of contract.

I am a working person and because I did not have time to independently deal with multiple vendors I decided to handover all work and its management to one company basis their representations and warranties. They claimed to have the best vendors, best materials and best workers, however, in the end I and my mother had to go to the Site everyday from *nd December **** and make everyone finish the work as I had no choice but to move in. I was paying EMI and rent and hence seeing the slow progress I would have been either homeless or made to pay escalated rent for Jan & Feb ****. Further there workers have damaged the tiles which now has white scratches and spots. The kitchen cabinet handles are all scrapped and sharp. I had to work and manage their workers in order to move into my home on *th December, which continued to be unfinished for other works like grill painting the mosquito net replacement (which is not yet done). All this time the main SPOC Subodh has been fighting with us even though he hasn't visited the Site and does not know what's happening and is harassing me purposely by instructing his vendors not to finish the work and keep pushing it.
