Sub: Mesmerizing, promising and misleading advertisements.
Full Refund and compensation for trauma & torture caused by the company.
Respected Judges:
To whoever is reading my complaint;
Personally, if you are buying a TV for your family, would you buy with an expectation
that it will or it might work ONLY for a couple of months or years or until the Warranty is
void OR that it will work for few years at least *-**-** years? Would you buy a new TV
every year or two? Or would you be willing to buy at an average of **-**K per year?
Will you be ok to get home a TV for which you have to pay an average percentage of
amounts yearly that doesn’t work after?
Definitely you won’t buy or invest **k-*-* lakhs for a TV that works for *-* years.
My Name is Prasad. I am a resident of Hyderabad.
I am ** years old, retired Indian Air Force personnel.
Due to my age and Covid restrictions our only entertainment is limited to watching TV.
After seeing many mesmerizing and misleading ads of MI TV claiming to be India's Top
No. * Smart TV brand (Please see the below advertisements substantiating their
claims) – Annexure I & III
I finally bought from my pension amount, as I am not eligible for a loan considering my
age, under my son’s name.
As claimed by the company as India’s No * TV brand, the Worlds Thinnest LED TV with Ultimate LED Display , Flagship Performance, Work of Art kind of claims, it just stopped working properly, since
December ****, with Display issue, Flickering & Blue screen issue and suddenly stops
working. It did not work more than *years. Had I unfortunately been eligible for loan, the EMI would still be going from bank account for a TV that that does not work anymore, and did not last even for **
months of any normal EMI period.
Xiaomi India Customer Care Ref: TVIN*************: The product is now Out of
warranty; the India’s No * TV Brand company is refusing to replace the TV and would
only repair on chargeable basis. (Please see attached Annexure III) I did call the MI
service personnel and in their own words - "Even if TV is repaired it will not last more
than few weeks and the current issue of display panel distortion will resume. He
suggested me to buy a new one instead of wasting time on repairing one."
After I lodged my disappointment with the company’s MD’s twitter handle, and emailed
him (please see attached email copy below) – Annexure III and IV.
I was approached by the company’s customer service people, asking me to go for a
repair for display panel on chargeable basis, which would cost me around or over
Rs *****-*****, almost equal to the cost of a new TV. After a lot of conversation trying to
convince me to go for a repair on chargeable basis, He also said that if I go to
consumer court it would only delay the process over a year or more with no
guarantee that I will get any replacement or refund. These were the words of their
customer service personnel.
Pursuant to the chronology of the events, I wanted to file with the consumer
court, because I am appalled by the audacity of the employees of the company.
I still have the faith in the Judiciary which is an important tenet of the democracy of India.
When their out of warranty repair is not going to work longer, When their India’s No * TV brand does not last at least a decade (considering my old
CRT TV which is working for ** years),
When their advertising is misleading as India's No. * SMART TV, with Ultimate LED
Display claims or such as “Work of Art” kind of claims,
Flagship Performance, “Revolutionize how you watch TV” kind of advertising
Then the company or service provider has to replace the TV properly or change their
misleading advertisement and issue an apology for past advertising so that other
gullible veterans are not fooled by such corporates.

The Advertising Standards Council of India - ASCI
You have given permissions to these companies.
You are the Authority, Please take relevant action.
ASCI’s being the authority has responsibility to curtail such rampant, mesmerizing and
misleading advertising and make these corporates responsible to set the expectations
right for the customers. They should not claim as India’s No* TV brand, or advertise that
their No * TVs does not last more than *-* years.
I as an old soldier who worked for the country would like to ask the honorable judge to
put yourself in my place and ask would he purchase a TV expecting it to work just for a
couple of years and then run around looking for a new one or would fight for his rights?
In this situation of pandemic, when it is required to stay at home, if our only avenue of
relaxing by watching some TV is not working, then our mind after a point will become
senile. This is nothing short of slow and decaying torture which the sales and marketing
team of MI TV will not understand before displaying misleading advertisements all
across internet and social media.
They just sell and forget the customer; they don’t try to protect their customers, and their
interests.
They are into business, doesn't mean they sell and forget their customer or leave them
to suffer giving excuses and reasons for all their other sales.
Atleast they should protect their customer first.
Would any of the Judges or the company personnel agree to buy a product and let them
come open for a repair after paying **-***-***k ?
I am not even up for a repair. I am not interested in opening the TV for any repair.
If they can replace with brand new TV, I Welcome. Or I claim for a full refund.
Preferably I pray the court for a full refund as they could provide defective product again
If India’s No * TV Brand Company cannot protect its customer’s interest, why should the
customer give business to them?
And then give more business in the name of repair?
That will be My Blunder if I repeat my mistake.
They send Free brand new TVs for their ratings to many you-tubers and others to
advertise and comment, but don’t protect your main customers that actually PAY to buy
their so called No * product. That's pathetic. First company should protect their
customer. That's basic customer service.
I pray before the Honorable court to ensure that that company gives full refund, and
compensate for the trauma and torture I have to endure for buying a product in faith
after going through their highly worded and promising advertisements.
