Third Wave Coffee Roasters - Gross Negligence Head Injury at a Third Wave Coffee Roasters caf

On the **st of December ****, I was injured on the premises of a Third Wave Coffee Roasters café, located at **th Cross Road, PWD Quarters, *st Sector, HSR Layout, Bengaluru, Karnataka, ******. The incident occurred on a Tuesday afternoon, just after * p.m.

I was seated at one of the tables, waiting for my order, when a hard and heavy piece of the café’s ceiling, including brick/tile and glass, fell and struck my head. I was admitted to the emergency room of a nearby hospital, where my bleeding head had to be shaved in order to treat the wound.

As a result of the injury, I suffered an enormous amount: continual physical pain and headaches; loss of income as I was unable to work while recovering; loss of time as I was in the process of moving and apartment hunting, and missed other administrative appointments; embarrassment of a shaved head; stress and mental anguish, as I am now too afraid to sit in a café or restaurant; and a ruined festive season, including missed events.

This is gross negligence due to Third Wave Coffee Roasters’ faulty building construction and lack of concern for customer safety, yet they claimed that it was not their fault but that of their landlord. Instead of offering proper compensation, which is appropriate in the case of a dangerous incident that occurred on their property, they tried to downplay the seriousness of what happened by offering me store merchandise and stating that their customers are safe in that store. They also did not install the safety netting on their ceiling, which they claimed they would. They have clearly breached their duty of care towards their customers and are not taking responsibility for what happened.
