has entered into a contract of export (waste plastic scrap in roll form) to India for which the ***% advanced payment has been sent to the company for * containers to which the company agreed that the price of * containers include the cost, insurance & freight charges and upon asked several times that is there any further more payment is required to be sent after the payment of * containers to which the company employee simply denied that no more payment to be given. The company has contracted with Pacific Freight & Logistics shipping company having registered office at

Web : www.pacificfreight.net for the transportation of containers from Durban port South Africa to Dadri port India for the shipment to be scheduled for **/**/**** to which the shipping company has informed us on **/**/**** regarding the pending Container rental fees and other fees to be paid by the buyer for which the seller i.e. Alcatras company didn’t informed in advance. The cost of * containers which was paid to the Alcatras company was *****usd further the pending Container rental fee and other fees are imposed which was demanded as ****usd to which the shipping company has clearly stated that if fees is not paid then the goods will be quarantined and Penalty will be imposed. The pending Container rental fee of ****usd was paid in the name of Alcatras. After the payment of container rental fee the demurrage fees has been imposed due to delay in payment of fees making a further demand of ****usd. The demurrage fee of ****usd was paid in the name of Alcatras. After this all payment a new schedule was given with a tracking link showing the shipment to be arriving on **/**/**** to Dadri Port India, also the shipping company has said earlier that they will be providing a custom clearance agent for getting the goods cleared at the Indian port. On demanding the details of the clearance agent it was said that the details will be provided * days earlier before the shipment enters into India. The tracking link given by the shipping company was of no use as it is at present i.e. on **/**/**** is still showing the shipment as enroute. Asking several times from them the shipping company has demanded ****usd for Indian custom taxes and duty to get the goods cleared to which the buyer i.e. SS International has refused that the clearance will be done by the buyer itself and which was not decided in the contract terms but the seller Alcatras and the Pacific shipping & Logistics company didn’t agreed and demanded the amount to be paid making it mandatory or else the master copies of the documents will not be handed over to any other third party agent. Again suppressed by the demands of the shipping company and seller Alcatras the amount of ****usd was paid in the name of Alcatras. After the payment has been made there was no details of shipping agent and status of the shipment was provided to which several mails has been dropped to the shipping company and seller Alcatras but no reply was given. On **/**/**** the shipping company has sent a mail with the following words “ Dear Client,

It been a trategy and we have not been able to get you updates regarding
your shipment which has been with us for this past three weeks, Upon
arrival of the ship at your final port it was discovered that your four
containers were not on the ship, Due to the high tight that tried to wreck
the ship on it way to your port, The containers were among the containers
that were discharged from the ship in order to stabilize the ship from
being destroyed by the high tight,To that effect we have been in follow up
with your suppliers and the insurance company that handled your insurance
for the past days, We only struggled today to get information from
suppliers and insurers and they gave us ***% assurance that the suppliers
will reload the four containers back for you for free and shipment will be
handled by us and inspected up to delivery point,

Insurance company has also complied to the lost and is ready to cover all
expenses, delay lost and damages at this point, We are only waiting for
the insurance company to get all paper work in place refunds and claims
will be settled in due time, At this point in time the only good news we
have is that your suppliers are ready reload the same goods for you for
free so we will update you once we confirm with your suppliers on when
good are ready for departure to your port,

It was a shock given by the shipping company to show that how a situation is to be mould for demanding more & more money from the innocent buyers who are building a relations between two countries. The buyer SS International has replied to the mail for the refund of total amount paid i.e. *****(* containers fee)+ ****(container rental fee & additional fee)+ ****(demurrage fee)+ ****(Indian custom & taxes with other fee) usd =*****usd with the delay and harassment penalty to be paid to the buyer to which there is no reply received and neither the details of insurance company is provided.
I hope that government of South Africa will look into the issue on priority basis and will settle the issue.
Relations between two countries is to be made stronger rather then making them weaken. Also a strict action to be taken against the seller Alcatras & Pacific Shipping & Logistics company.
