Brief description of matter for purpose of legal notice :
I had ordered from the party :
a. * seater lady gray italian marble top dining table with * nos chairs.
b. * nos lady gray italian marble top centre tables
c. * nos lady gray Italian marble top side tables.
d. * nos of black italian marble slabs
On January **-**th , ****
Full payment of Rs. *.** lakhs was made online part advance and full balance
payment by jan **, **** and acknowledged as received by Vikram Saini /
Hemant in the bank account of RGW impex. ( all details in pdf attached)
The party committed to full door to door delivery of all products ordered along
with installation team at delivery address. The dispatch of goods was committed
by Jan **, ****.
Post this date the party has not delivered any product. He has made numerous
false commitments to show ‘finished products’ and now almost ** days from the
committed dispatch date there is no product received. Unfinished and unclear
product pictures sent by him were not of my order and were those of prior orders
to mislead and cheat. (all details of false commitments in pdf attached)
This is a fradulent business activity as the party is neither supplying the goods
nor are they refunding as per numerous follow up requests both in writing and
verbal by me. This party has had prior such complaints as seen online from
previous customers, making him him a habitual offender. ( online complaints
from earlier customers in pdf attached)
Party did not even reveal his true legal name in all interactions , again clear intent
to fraud. It is only on checking GST records and manufacurers directory, that
party’s real true name was revealed.
Therefore I want to claim full refund of Rs. *.** lakhs with * percent interest per
annum calculated for the delay. I also want to claim damages of ** lakh rupees towards the economic loss of * months rental caused to me due to the delay in the furniture above and mental agony.
Based on the party’s official response in writing / email to the legal notice or if he
fails to do the refund of Rs *.** lakhs (plus interest at * percent for ** days), in
** hrs from date of legal notice, I will then decide to file FIR/ cyber crime
application and then decide to claim all further financial damages mentioned
above, in a court of law.
All information shared by me is completely accurate and I would like to get
satisfactory closure and justice in aforesaid matter.
