Irfan Tours Travels Jalalpur Ambedkar Nagar Up - Fraudulent Travel Service

I had to go to Jeddah from Lucknow via Dubai, where I had to stay from Dec **, **** to Dec **, ****.

I purchased the following services from Irfan Haider, Proprietor of Irfan Tours & Travels, Jalapur, Ambedkar Nager - ******, Uttar Pradesh, India against their invoice No. *** dated Nov **, **** (copy attached):

*. Air ticket from Lucknow to Dubai.
*. Travel Insurance.
*. Pickup from Dubai Airport to hotel.
*. Accommodation including food in a *-star hotel.
*. Drop from hotel to Dubai Airport.
*. Air ticket from Dubai to Jeddah.

Although, the invoice reads Rs **,***.**, I accept that I had paid Rs **,***.** as mutually agreed with them.

The above said agency fulfilled the above services except those listed above at serial No. * & *.

Before my departure from Lucknow on Dec **, ****, the agency’s representative, Zeeshan handed over to me the hotel booking at Lucknow Airport (copy attached). As per the said booking, my accommodation was booked confirmed in Al-Bustan Tower Hotel Suites in Sharjah.

On my arrival at Dubai on Dec **, ****, the agency’s representative, Ishan picked me up and took to a tiny and dirty room of a flat in a residential building located in Al-Nahda area of Sharjah, where I noted that I had to share this tiny room with addition six people having double decker cots. I told Ishan to take me to the above-said hotel as my booking was done there and showed him the booking paper. Ishan laughed looking at the hotel booking and ridiculously replied that this booking was fake. I shockingly told him that I cannot stay in this room and asked him to arrange my accommodation in a *-star hotel as had been promised to me. Ishan replied me that he cannot arrange any accommodation other than this and warned me not to leave this room. He also told me to talk to Irfan, whom I had paid for services. Later that night, food offered to me was horrible and then given AED **.** for three meals a day, which was again a breach of the services had been promised to me.

Subsequently, I contacted and informed Irfan via WhatsApp everything as stated above by providing evidences such as video of the room and photographs of the food. But Irfan only promised to take actions and provide the services as promised but did actually nothing form his sides.

Finding it difficult living in that tiny room, I contacted my elder brother’s friends in Dubai for help. They sent me their location and I left to their place on Dec **, **** and stayed there until my departure to Jeddah on Dec **, ****.

I have been chasing Irfan since then for refund of the money that I paid him for my accommodation and food. He initially responded on the plea that he had further sub-contracted the services in Dubai with another travel agency in Lucknow and he will refund me only when this agency refunds him. In reply, I told him that I don’t know anybody else other than him as my point of contact and agreement was him, I paid to him only and need refund from him whether or not the other agency pays him. Thereafter, he ignored my messages.

Eventually, I sent him a Demand Email (Pre-Legal Notice) on March **, **** asking him to refund me Rs **,***.** within ** days of the said e-mail, failing which will compel and constrain me to take shelter under Consumer Forum Court. I also warned him per the same e-mail that he will be fully liable for all the claims, costs and consequences resulting therefrom.

The ** days given time has expired and no fruitful response is received from him despite one reminder e-mail on April **, ****.

I also have his confirmation message sent to me on WhatsApp that his representative in Dubai did wrong in Dubai.

In light of the above, I would like to use your services to take up the matter in Consumer Forum Court so that I could be refunded.
