Ajay Modi Travels Private Limited - Deficiency in Service and Unfair Trade Practice by Ajay Modi Travels Pvt Ltd Leading to Financial Lo

The Complainants booked a travel package titled “* Night Gangtok, * Night Pelling and * Night Darjeeling” with Ajay Modi Travels Pvt. Ltd. for the period **.**.**** to **.**.**** by paying a total consideration of ₹**,***/-.

The Opposite Party had booked the onward journey via Akasa Air Flight No. QP**** scheduled on **.**.****. However, the said flight had already been cancelled approximately one month prior to the date of travel. The airline had processed the full refund of the airfare to the Opposite Party well in advance.

Despite having complete knowledge of the cancellation and having received the refund, the Opposite Party deliberately failed to inform the Complainants. Further, on **.**.****, i.e., one day prior to departure, the Opposite Party re-confirmed the travel itinerary, thereby misleading the Complainants.

Relying on such confirmation, the Complainants reached Ahmedabad Airport on **.**.****, only to discover that the flight had already been cancelled. No alternative arrangements were made by the Opposite Party, resulting in the Complainants being stranded at the airport and their entire trip being ruined.

Upon confrontation, the Opposite Party admitted its fault and assured a full refund. However, instead of refunding the amount, it arbitrarily issued a Credit Note of ₹**,***/- without the consent of the Complainants. Additionally, only a partial amount of ₹**,***/- was refunded, and the remaining amount has not been paid despite repeated follow-ups.

The actions of the Opposite Party clearly amount to Deficiency in Service and Unfair Trade Practice under the Consumer Protection Act, ****. The Complainants have suffered financial loss, mental agony, harassment, and public humiliation due to the negligent and dishonest conduct of the Opposite Party.

Hence, the Complainants seek appropriate relief and compensation from this Hon’ble Commission.
