I am a student residing in Dehradun, Uttarakhand. In November ****, representatives/staff members of Anytime Fitness convinced me to purchase a gym membership by assuring me that their gym branch would become operational “from next week” or within a very short period. Based on these promises and assurances, I paid approximately ₹**,*** towards the membership fees.
However, despite repeated assurances, the gym did not open for several months. The gym eventually became operational only around April ****, resulting in an approximate delay of nearly * months from the promised opening date.
From January **** onwards, after realizing that the promises made to me were false and misleading, I continuously requested the gym management and staff to cancel my membership and refund my money. Despite multiple follow-ups through calls/messages/visits, the opposite party kept delaying the matter repeatedly and failed to provide any proper resolution.
Whenever I requested my refund, the gym management started claiming that the membership amount was “non-refundable.” This condition was either never clearly disclosed to me at the time of payment or was unfairly imposed after taking the money through false promises regarding the opening date of the gym.
The conduct of the gym management amounts to:
*.False promises and misleading representation at the time of enrollment.
*.Unfair trade practice under the Consumer Protection Act.
*.Deficiency in service due to failure to provide the promised facility within the assured timeline.
*.Mental harassment and unnecessary stress caused by repeated delays and ignorance towards my genuine concerns.
*.Financial hardship, especially considering that ₹**,*** is a significant amount for a student like me.
I have been following up with the gym management since January ****, but instead of resolving the issue, they have continuously ignored my requests and caused unnecessary mental pressure and inconvenience.
Due to their misleading conduct and refusal to refund my hard-earned money, I have suffered financial loss, emotional distress, mental harassment, and loss of trust.
Relief Sought
I respectfully request the Hon’ble Consumer Commission to:
*.Direct the opposite party to refund the full membership amount of approximately ₹**,***.
*.Award compensation for mental harassment, emotional distress, and unnecessary delay.
*.Award litigation and complaint expenses.
*.Take appropriate action against such unfair trade practices so that other consumers are not similarly misled in the future.
