Rangers Club - Cheated by Holiday Planner

Rangers club deals in providing holiday memberships. They have organized a marketing campaign on **-Jan-** in Noida, Section **, Logix mall. There they deceitfully sold their membership plan by committing high level of services and various offers. They have this condition that one needs to buy the membership on the same day to receive those offers. Those offers were given in written and were signed. So I bought their plan for Rs.****** as they also committed me refund option if I am not happy after taking their first holiday. This option was in written and signed - “If you are not satisfied with services after taking first holiday, money will be refunded after deduction admin fees Rs.*****”. Documental proof is there for this.
But when I received their agreement letter, there were many differences in what I was committed and what was in the agreement (e.g. occupancy, AMC, Exchange cost, etc.) So I raised the complaint on **-Jan-** for my concerns and communicated the same to their representative on whatsapp. On repeated following up, I received an email from Rangers club on *-Mar-** listing my concerns I shared but without providing resolution for most of them. I again contacted the representative on *-Mar-** and mentioned the issues that were not resolved. He replied on **-Mar-** with “same amended as well”. But I never received any email or updated agreement letter, which I communicated to him. Then due to COVID and lockdown, no communication was made but as per his last confirmation all issues were resolved. Then after lockdown and getting our vaccinations, I tried to plan my holiday to Shimla in October **. I emailed them with the required details. I was communicated back that the grievances I raised earlier are still open and so my membership is Not Active. For doing the booking, they wanted me to send confirmation email to accept that my grievances are resolved. That time I came to know that my concerns were still not resolved. After many back and forth communication on email and phone, they accepted concerns related to occupancy and AMC with some amendments and I also agreed to those two concerns as I want to plan my holiday. Then first they confirmed me the booking for **-Oct – **-Oct-** in the hotels I requested. Then at the last moment (on the evening of **-Oct-**), they told me my booking for **-** Oct is cancelled due to non-availability in that hotel (Club Mahindra, Kandhaghat). I was shocked as I had to travel early the next morning and they now telling me that my booking is cancelled which they have confirmed earlier. Despite many requests they could not give me that hotel on those dates. But when I tried at Club Mahindra directly, I was getting the availability and had to pay full amount despite taking the membership of Rangers club. Also, I have to face issues in the accommodation they provided me in one of the hotel on **-Oct at Chandigarh, despite they committing they give accommodation in *-* star category hotels. I have the video proof of the same. After that no-one contacted me on **-Oct, despite knowing my holiday plan is till **-Oct and they didn’t provide me with any booking. I have to manage my-self with my family with kids and arrange the hotels despite buying their membership. So when I returned, I emailed them that I want to cancel my membership as I am not satisfied with the way they planned my first holiday, and they would process refund by deducting Rs.***** as per the agreement. They replied initially by saying they cannot make refund as cancellation option is within *days (which they have mentioned in their agreement letter but I didn’t agree to that and had already raised this concern among others on **-Jan-**). They have mentioned in the email on *-Mar-**, that cancellation within * months of joining but I never agreed to that. In the document that I have signed, no time clause is mentioned for cancellation. It only says, ‘if not satisfied after first holiday”. I have done lot of email communication and they instead of talking to me and try to resolve my concerns I faced during the trip, they just keep sending me repeated email with same content again and again that says cancellation cannot be done after * months of joining. Though my agreement doesn’t mention any timeframe, but despite that, they have activated my membership only in Oct ** but they are considering me joined in Jan **, even though I have raised concerns at that time only.
Even though I was at loss of Rs.***** deduction where they have not provided me any worthful service, they are not giving me refund. So I am left with no choice but to follow legal route and now I would demand not only complete refund but compensation towards the mental agony that me and my family has faced during the trip due to their pathetic services.
