Amit Tour And Travels - Booking amount not refunded

During November **** I planned a holiday trip for us (we three couples together) to Himachal Pradesh during **.**.**** to **.**.**** through Amit Tour and Travels – Delhi. The tour operator gave the quotation of *,**,***/- for three couples and to confirm the booking I initiated a token payment of **,***/- on **.**.**** through online mode (Receipt is attached). On demand of the tour operator I added more **,***/- on **.**.**** (Receipt is attached). As the tour operator offered the Ex Delhi package I also booked round trip air tickets to Delhi for all three couples. Now, Due to COVID pandemic the government of India had announced a complete lock down from **.**.**** onwards. For obvious reasons it would be next to impossible to travel for us on the mentioned duration and because this was a completely uncontrollable situation I corresponded to the airline to initiate the refund and asked the tour operator to refund the booking amount (i.e. *****/-). After a long legal fight to airline, the airline refunded the full amount back but, on demanding the refund to the tour operator, he dined to refund and boasted that he will be offering me an open ticket instead of the refund and by using the open ticket I will be able to utilize the advanced paid amount in future trip. I understand that normally the booking amount stands nonrefundable but COVID-** and lockdown are completely non-controllable situations and so he should refund the booking amount. Still I trusted him and during past time period, I approached to the operator and tried to reschedule the trip but every time he showed a new excuse like “It is peak season, so you have to pay higher amount” or “Your trip is for three couples and only you three couples will be able to redeem the open ticket” or “If any of your couple is not coming, then only partial amount will be redeemed” etc. and did not sent me the booking vouchers anyhow. This kind of responses and his unethical approach forced me to think deeply to trust him and that is why I did not want to deal with him more and did not want to reschedule my trip with him, hence I finally called him on **.**.**** to refund my booking amount to me or else I will take the legal support, then he got ready to refund **% of the booking amount (I.e. *****/-) within next * months. This kind of negotiation clearly indicates his mala fide intention and his escapes from legal actions show how much he would be conducting tax thefts and other fake commitments to other customers also. As *****/- is not a small amount for an honest taxpayer like me and additionally the feeling of ‘being cheated’ hurts a lot, I sincerely request you sir to force him to initiate the full refund of my booking amount to me and take very strict actions to these kind of unethical operators so in future other innocent people may be saved from such cheating actions. With a lot of expectations, I am raising the dispute in front of you sir, as in the past the consumer forum worked very intensively and every time it has shown concrete solutions to me. Jay Hind.
