Sir,
Sub: Complaint regarding harassment by House owner and non-refund of deposit money-reg.
*. I signed the Rental Agreement executed on **/**/**** and agreed to pay Rs.****/- as monthly rent for the *st floor house owned by Mr. Vasudeva K.P. which is located in the following address ***, *th cross, Raghavendranagar, Mysore-****** from **-**-****. I also paid ₹.**,*** in online mode as Rental advance and the same was deposited in the account of Mr. Vasudeva K.P and his wife Mrs. Prabhamani . It was a newly constructed house and I was the first tenant to occupy the house.
*. I paid the first rent ₹*,***/-+ *,***/-(through online banking). but as per Rental Agreement the rent to be paid was ₹.*,***/- but forcibly he started taking ₹*,***/- extra every month and ₹ ***/-towards monthly water charges and I paid the electrical charges separately as per the agreement.
*. I paid totally ₹.**,***/- extra rent and it was forcibly taken from me illegally by not honouring the rental agreement. I deposited every month the Monthly Rent and Water charges in his daughter’s bank account as per his instructions. And I paid Electricity charges separately to Electricity Department in online mode every month.
*. As I was aware that I am going to be allotted government accommodation , I gave the owner two months prior intimation in writing that I would be vacating the house as and when I get allotment order. After I was allotted government accommodation, I vacated the house on **-**-****. I have paid the rent till **th November ****.
*. On vacating the house ,when I approached the owner to get back the advance amount, he said I have to pay ₹.**,***/- towards painting charges and other maintenance charges which he will be deducting from the rental advance .This unethical act of deducting such a huge amount by the owner is against House Rent Act &Tenancy protection act. Also this deduction was not in accordance with the Rental Agreement signed by both.
*. When I requested him to sign a receipt showing final settlement ,he refused to sign saying that “I will not sign anything in writing as there is no such procedure in Mysore” and insulted me by shouting with harsh and bad words. This act of him clearly proves that he retained the advance money of tenant illegally and was not willing to sign the settlement copy as he had a fear that if he signs he will be caught. After I said to him, I shall give Police complaint if he does not sign the settlement copy ,he returned only Rs.***** /- retaining Rs.*****/- towards Painting and Maintenance charges which is a great loss incurred by me and grave injustice done to me.
*. Moreover, he deducted ₹.***/ as electrical charges for ten days but all these months I paid only ₹ ***/- on an average for the entire month. Finally, he insulted me by saying ‘get out’ by forcibly taking the key and not giving any refund.
*. I have vacated the house in good tenantable condition without any stains on the walls and without any damages of fixtures . But he claimed that there were small patches and little fading of colour of front and rear doors which are exposed to Sun , wind and rain which is inevitable. I took photo of house inside on **/**/**** before handing over the key to him to safeguard myself , as I came to understand his greed for money and his mentality to extract more money in some way or the other from me.
*. His greed for money and his unethical demand of Rs. *****/- towards Painting charges and Rs. ****/- towards Maintenance charges is evident from the whatsapp message sent from his mobile with the split up of money asking me to settle all the amount from the Rental advance.
**. Now I wish to seek justice for this injustice done to me by the owner Sh. Mr. K.P.Vasudeva and he should apologise me in writing for his unethical acts which he should not do it for any tenant.
**. Apart from this, he should pay me the following amount which he has retained
illegally with him.
*. Painting Charges demanded by him. = Rs.*****
*. Maintenance Charges demanded by him = Rs.*****
*. Extra rent paid for ** Months = Rs **,***
*. Difference in amount as (*% of ****- *% of ****)x ** =(***- *** )= **x ** = Rs ** ***
Total Amount Due to me Rs.*****
I enclose herewith all the documentary evidences in support of my case for your consideration and justice .
