Khosla electronics pvt LTD - AC still not delivered

I would like to lodge a complaint against Khosla Electronics Barasat regarding non-delivery of an Air Conditioner despite taking advance payment from me and misleading sales practices followed by their sales executive.

On Sunday, I visited Khosla Electronics with the intention of purchasing a Godrej AC. However, the sales executive very conviniently convinced me to purchase an IFB AC model instead by assuring me regarding its availability and timely delivery. Later, I came to know that the particular IFB model is unavailable in the market.

Despite taking an advance payment of Rs. **,*** from me, the AC has still not been delivered. I have repeatedly contacted the showroom regarding the delivery, but they are continuously avoiding the issue and are not providing any proper assistance. Neither are they delivering the AC nor refunding my advance amount.

This situation has caused severe mental stress and inconvenience to my family because my mother is a stroke patient and suffering from brain tumor at my home who urgently requires proper cooling due to headaches and care. Even after informing them about the medical emergency, they have shown irresponsible and insensitive behavior.

The actions of the showroom and the sales executive amount to deficiency in service, unfair trade practice, and misleading representation under the Consumer Protection Act.

Therefore, I request the Hon’ble Commission to kindly:

Direct Khosla Electronics to immediately deliver the AC as promised or refund the advance amount of Rs. **,*** without delay.

Award compensation for the mental harassment, inconvenience, and suffering caused to my family.

Take appropriate action against the seller for unfair trade practices and deficiency in service.

I am attaching copies of the payment receipt/invoice and relevant communication records for reference.
