Suresh Kumar Gupta Plot owner Garha Gorakhpur Jabalpur - Seller Denying Full Refund of 1 Lakh Plot Bayana Due to Collector s Stay on Illegal Colony in Jabal

I booked Plot No. ** (**** sq.ft., **x** ft.) in an unauthorized colony of "Gujrati Colony" at Garha Gorakhpur, Jabalpur (Khasra No. ***/* & ***/*, Mouza Garha, Tehsil Gorakhpur) via a sale agreement dated **.**.**** with the seller [Suresh Kumar Gupta]. I paid ₹*,**,*** (One Lakh) as bayana (earnest money) via UPI (Transaction ID: [************]) on **.**.****, with a total agreement value of ₹**,**,***.

As per the agreement, the seller was obligated to clear their existing bank loan, obtain NOC from the bank within ** days, and execute the sale deed (registry) in my name. However, the Jabalpur Collector has imposed a stay order on name transfer (namantaran) for all unauthorized/illegal colonies in the district, including this plot, making registry and legal transfer impossible. This stay was issued in late **** and continues as of April ****.

The seller is now refusing to refund my full ₹*,**,*** bayana amount, offering only ₹**,*** despite the breach being entirely on their end (failure to provide clear title and obtain necessary approvals). They are pressuring me to proceed with registry in an illegal colony, which is legally void and risky. Due to this, I am unable to invest in other legitimate plots and facing financial harassment.

This constitutes:
