Complaint against Indian Money.com for Fraudulent Misrepresentation
I was called by a salesperson of Indian Money .com to their office at ** Vinay Arcade, K.H. Road, Bangalore on *th February, ****, promising to give me leads from corporate executives who would buy insurance policies of high premium. They made me buy the most expensive package for Rs. *,**,***, saying this will give me high-value leads. Their product was one mobile app. Called Lead Market, on which the leads would appear. No Terms and Conditions were shown to me or mentioned. They pressurized me into making immediate payment. I said I did not have so much money, so they made me pay through credit card. I was not allowed to go home to think of pros and cons. They made me sit in their office to receive the ‘Welcome Call’, because accepting the call would mean accepting the terms and conditions.
On reaching home I received an e-mail with the invoice and Terms and Conditions as attachments. I realized what a mistake I had made, so next morning I returned to their office with the Senior Partner from Kotak Mahindra office to ask for cancellation and refund of money. They refused and their Sales Manager used aggressive language.
I bought some of the leads that were coming on the app. They were mostly cab drivers and gas delivery boys, very far from corporate executives. Some of the phone numbers and addresses were fake. They did not speak English, so I could not communicate because I cannot speak Kannada.
This app. was of no use to me. So, I wrote a letter to the CEO of IndianMoney.com asking for cancellation and refund, after deducting the money for the * leads I had bought. The company’s representative Mohan Kumar contacted me and said there is a no refund policy.
In their document it is mentioned, “it is strongly recommended that before subscribing to the paid services and making payments, the Service Providers should read and note all prescribed terms and conditions, privacy policy mentioned in the LeadMarket App.” In my case this was not followed, because the documents were not shown to me or even mentioned when their sales personnel were bulldozing me into making the purchase of the package.
I approached Online Legal India for legal help and they sent a lawyer’s letter asking for refund as well as compensation for financial and mental trauma that I have suffered. There was delay due to the lockdown, but the letter was delivered on **.*.****(tracking record available). Till now there has been no response from the Company.
