( OP.No.1,2,4,5,7,8,11 & 12 Placed Ex-parte and OP.No.3,6,9 & 10 Dismissed as per order on memo dtd: 12.04.2018.) JUDGEMENT By Sri.A.G. Maldar, President. 1) The relevant facts of the case is that, the complainant has filed the complaint U/s. 12 of the Consumer Protection Act, 1986, against the Ops, alleging deficiency in banking service of non refund of the S.B. A/c amount with interest. 2) Inspite of service of notice to the OPs. The OP.No.1, 2, 4, 5, 7, 8, 11 & 12 have remained absent. Hence, placed ex-parte and OP.No.3, 6, 9 & 10 are dismissed as per order on memo dtd: 12.04.2018. 3) In support of the claim in the complaint, the complainant has filed his affidavit and produced one document i.e., Original S.B. A/c Passbook, for sake of our convenience, we have marked as Ex.P-1. Heard the argument of complainant counsel and perused the records. 4) Now, the following points that would arise for our consideration in deciding the case are; Whether the complainant has prove that there is deficiency in service on the part of the OPs for not settling/refunding the S.B. A/c amount? What order? 5) Our finding on the points are as follows; 1. Partly in the Affirmative. 2. As per final Order. R E A S O N S 6) On perusal of contents of the complaint and affidavit filed by the complainant, the complainant submitted that, after the date of maturity of the F.D. amount, the complainant personally demanded and requested the OPs for refund of matured F.D. receipts amount, but the Ops have asked the complainant to surrendered the said F.D. receipts to the OPs and as per say of OPs, the complainant has surrendered the F.D. receipts No.7103, 7104 & 7105 to the Ops and the OPs same have been get it transferred to Savings Account to the complainant and its bearing No.465/SB on dtd: 10.08.2017 for Rs.3,22,584/-, after the transferring the F.D. amounts to the S.B. A/c, when the complainant approached the OPs for withdraw the amount from the S.B. A/c as stated above, but the OPs did not allow to withdraw the said amount from the S.B. A/c. till today. So, these attitude of the opponents, it amounts to deficiency in service and thereby the OPs committed deficiency in service as contemplated under the provision of the Consumer Protection Act 1986. Therefore the complainant is constrained to file this complaint against OPs. 7) On perusal of the affidavit filed by the complainant and the original S.B. A/c passbook produced by the complainant, which is marked as Ex.P-1, inspite of the demands made by the complainant, the S.B. A/c amount remained unpaid, the contention of the complainant stated in the complaint has to be believed and accepted and it has got merit. Inspite of service of notice to the OPs. The OP.No.1,2,4,5,7,8,11 & 12 remained absent. Hence placed exparte and OP.No.3,6,9 & 10 are dismissed as per order on memo dtd: 12.04.2018. It is well settled legal position that, non-payment of the amount deposited, it amounts to deficiency in service. 8) Taking into consideration of the facts, evidence on record, so in our consider view, the complainant has proved the case and complainant is entitled the S.B. A/c amount with interest @ 4 % P.A. from the date of transfer to the S.B. A/c i.e. on 10.08.2017 till realization to the complainant and the discussion made here before deficiency in service on the part of the OPs have been proved. Hence, we answer to Point No.1 in partly Affirmative. Accordingly, we proceed to pass the following. O R D E R For the reasons discuss above, the complaint filed by the complainant U/s 12 of the C.P. Act ? 1986 is hereby partly allowed with costs. The claim against OPs No. 3, 6, 9 & 10 are dismissed. The Opponents No.1, 2, 4, 5, 7, 8, 11 & 12 are hereby jointly and severely directed to pay the complainant S.B. A/c bearing No.465 of Rs.3,22,584/- with interest @ 4% p.a. from the date of transfer to the S.B. A/c i.e. on 10.08.2017 till realization to the complainant. Further, Opponents No. 1, 2, 4, 5, 7, 8, 11 & 12 are hereby jointly and severely directed to pay a sum of Rs.2,000/- to the complainant towards cost of the proceedings.
