This is with reference to the subject, I am a resident of D-***, Shreepati Arcade Annexe-II CHSL, Mumbai – *** ***. Maharashtra.
The vendor Applect Learning Systems Pvt Ltd, having Head office at A—***,*nd Floor, Okhla Phase-*, New Delhi- ****** having branch office at Applect Learning Systems Pvt Ltd, ***,A-wing, *th Floor, Sagar Tech Plaza, Sakinaka Junction, Andheri Kurla Road, Andheri East, Mumbai -*** ***(hereinafter as “ALSPL”) contacted me through their customer service representative in the month of Jan, **** for selling their product under the name “Merit Nation” for studies of children from Class *st to Class **th. They inquired about my child’s school and which Board pattern they follow, to which I replied that for subjects like Maths, Science, English, Geography and Hindi they follow ICS board pattern i.,e Macmillan Publisher and for rest subject the school follow Maharashtra State Board.
Accordingly, on **.**.****, the ALSPL contacted me for an appointment to show a demo session for my child Master Nilay Joshi, studying in Standard * in S.M. Lodha High School, Gamdevi, Mumbai-*. I asked them to come on **.**.**** at *:** pm. Accordingly, their counsellor Mr Saurabh Jaiswal fixed the appointment and came down to my residence at scheduled time and date to show the demo of the Merit nation about how it can augment the child in their studies. The counsellor asked which Board pattern the child’s school follows, to which I replied the same that I had given to their customer service telecaller the mixed pattern of ICSE and State board.
The counsellor showed the demo to my child over his laptop and showed him * animation video. During the session, my child asked some questions and about how to locate topics, etc. After the demo which got over after ** minutes, the counsellor asked about his subjects and school pattern and also asked whether we would buy the package which comprises studies for *th, *th, *th and **th standard syllabus. The package consisted of a tablet with inbuilt subjects and syllabus standard wise and the same can be viewed in offline mode also and not necessarily online.
He also told me that the child was selected under Merit nation scholarship random selection and will be eligible for the Tablet based package at price of Rs.**,***/-(Rs. Thirty-Three Thousand Five Hundred and Six only). I asked him that the online portal has been designed to cater only either to SSC/CBSE/ICSE Board pattern, whereas my child’s school follows pattern partly SSC Maharashtra Board and partly ICSE Board which is not enabled in the package. The counsellor replied that the vendor will provide me with a custom made tailored package catering to my child’s topics and syllabus. He further promised and said that I will have to provide the detailed topics and chapters in their excel format and once they receive it will be updated in the offline as well as the online mode in the Tablet. Based on his promises I paid the sum of Rs.**,***/- by credit card and subscribed the package.
On **th Feb ****, the counsellor sent me an excel sheet on my registered email ID asking me to fill the details of various topics, subjects, author name and publisher’s name. On *th Feb ****, I replied over the email with details of all topics subject wise with author name and publisher’s name. On **th Feb ****, I got an email from Merit nation that they are working on the topics as given by me to customize and make it tailor-made so as to suit to the child’s need.
On **th Feb ****, I got a call from merit nation stating that they have updated the topics and asked me to log in to the account to see the topics added and also said that they can provide it only in online mode and not offline-mode. The caller further stated their inability to incorporate the topics for the English Subject and Hindi Subject which is of ICSE pattern. I replied that the counsellor promised me that the custom made will be provided for all topics as promised as well as in offline mode. The merit nation staff informed me that they will forward the request to their software team to resolve and provide in offline mode.
Pursuant to the email and call I checked the tablet with online mode and viewed the topics along with my child, wherein I found that the topics added were not relevant as provided by me in the excel sheet and also * topics on Maths were not added. Again I wrote an email stating the same, to which I got a reply that they have added in the different name. The child again went through the portal in the tablet in online mode and found that none of the topics which I asked to incorporate matches with what merit nation has added.
Finally on **th March,**** I requested and asked them to again go through the excel sheet and add the topics as requested and also provide in offline mode and failing which I requested the ALSPL(vendor) to refund me the money paid as they have failed to fulfil their promise and breached the trust of the contract entered into.
Therefore I am writing this to the Consumer Grievances Authority to take cognizance of my complaint and ask the ALSPL to either perform the contract as specified by providing topics as requested in tailor-made format and in offline mode or refund the money. Kindly provide justice.
