- Refund not processed after repetitive follow ups ^Open

Respected Madam/Sir,

My name is Vishal Sharma.

We booked an upcoming project by Xrbia Builders located in Balewadi Pune in the year **** and paid a booking amount as a pre launch amount of Rs. ******/-. We paid this amount in June **** and were informed that the project will be launched in July and then we will have to apply for a loan to register for the flat.

During diwali they said that there is some delay and will launch in the new year. This went on for good * years and then we gave up and filed a withdrawal request in **** with their customer support team. They shared all documentation of submitting a withdrawal form and took a cancelled cheque copy saying that the amount will be refunded to our bank account in two months.

Nothing happened and we started following up again. We then visited their office in **** as noone was responding to our calls. We met the accountant and he said that refunds have been processed for most of their customers and ours is scheduled next month . We then started following up with the owner as we got his number through someone. He said that there is some cash flow issue due to covid and the company will payback our amount soon. We gave up our hopes and then sent a legalnotice in September **** but received no response. Last year my mother was hospitalised and I needed that amount for her better care . She passed in April ****.

This entire experience has caused me and my m=family a lot of mental stress and trauma. What could have been happiness of buying a new home turned into a nightmare for us. We can;t imagine how these big builders just play around with people's hard earned money. We are a salaried couple and for us this is a huge amount to let go. we need help from Consumer court to get our refund with interest for each year plus compensation for mental agony.
I have all proofs of emails, whatsapp chats with the owner and team to show as evidence. Please help us get our money back.
