- Real State company not refunding money ^Open

Fraud and cheating committed:
*. When company approached to me for sale of plot, it claimed to be HMDA approved layout which was not. The plot was approved by HMDA only on **th May ****.
*. Originally plot # ** was allotted but when HMDA approved the layout and plotting was done, structural changes were made and a new plot# ** was allotted and I was not happy with it and expressed dissatisfaction with Surendar Kumar to which he gave discount of **,*** and asked to pay rest of the amount if I wanted the land. I had no choice to take the land.
*. I took a loan of * lakhs from my sister to pay for the land. Me and my wife broke their Provident Fund amounts and paid to Surendar Kumar for the land.
*. Even after the sales agreement was made and * lakhs for the land and *,**,*** was paid for the registration of the land, the land was not given to me
. Here another fraud was committed. When in October, Surendar took money for registration much before that the plot # ** was sold to Shailesh Jain. Here intentionally Surendar Kumar Cheated me asking to pay for registration of land when it was already sold to Shailesh Jain and Surendar had no ownership of the land.
*. Realizing that a fraud has been committed I approached Surendar Kumar to refund the money or give the land. Surendar Kumar refused to give that land and asked to take another land. I refused to take any other land and Surendar was violating the agreement and I asked to refund the money. We met with Surendar Kumar and asked to refund. Surendar kumar informed that he is unable to refund due to COVID and I agreed to give * months’ time. An agreement was made on on *.**.**** as per which Surendar agreed to pay ** lakhs in * installments – * lakhs on **th May **** and **th June ****. Surendar again failed to pay this amount citing excuses.
*. From then, I HAVE been running around Surendar Kumar to get his money and Surendar has always failed to return and he does not want to return money.
