We took office space in this co-working in Lucknow and deposited Security Deposit (SD) with them in ****.
Since then we were paying regularly on time all their monthly invoice and they never sent any notice / email for any pending invoice or dues.
As their old facility has been closed recently in Lucknow and they were unable to accommodate us in their new facility so we demanded refund of Security Deposit.
To our shock they refused refund saying that there is no Security Deposit from us and instead demanded us to produce a receipt of Security Deposit to prove that we deposited.
We searched and sent Security Deposit receipt to Incuspaze and asked them to refund immediately.
Luckily they accepted and sent apology and an acknowledgement from their side that they will process the refund within * working days.
But when we did not receive refund in promised time, we followed up multiple times for payments. But to our surprise they came up with a cooked up story that our Security Deposit was adjusted for a pending bill of May ****, which they never sent and informed.
It is to be noted that as India encountered the second wave of COVID-** (the Delta wave) during a four-month period spanning April to July **** and nobody was attending office. Thats the reason they neither sent invoice nor followed up for monthly payment as it was waved-off for almost all the tenants in the facility.
Infact many occupants did not pay from April to July **** and hence the Invoice for the month May was never sent and due. Moreover neither a receipt of the deduction nor any notice was sent to us, which clearly shows it was never adjusted at that time.
Also if Security Deposit was deducted but then why did they never ask / inform us to deposit it again to continue the service? Without Security Deposit why were we allowed to use the facility?
But they did not do anything and silently allowed us to continue till ****. Thats strange and clearly shows their ill-intentions to illegally forfeit our SD amount as they do not have intention to refund.
