- GST Input credit was denied Closed
i purchased mobile from amazon and i am eligible for gst tax input credit because i am a registered gst Taxpayer and taxes i pay against any product or service i am eligible for input credit the gst Act
(vide u/s Section ** of gst – Eligibility and conditions for taking input tax credit
(*) Every registered person shall, subject to such conditions and restrictions as may be prescribed and in the manner specified in section **, be entitled to take credit of input tax charged on any supply of goods or services or both to him which are used or intended to be used in the course or furtherance of his business and the said amount shall be credited to the electronic credit ledger of such person.)
I attempted to communicate to Amazon through Email (over *-* times), calls, Chat mode etc. but they denied giving invoice with my gst number mentioned. because of which i cannot claim gst Credit and lost the tax i paid. i literally felt ill treated and made to run polls to pillars for the credit but sheer insufficient knowledge of customer care people and adamant approach of amazon have caused lot of torture and mental agony. more than money loss it was terrible approach which hurts more.
even to one of mail communication a customer care person replied many customers ask for same but they have limited resource and can only state it can be facilitated through b*b option not in regular mode. it was merely evasive tactic used by amazon herein.
Amazon stated blunt reasons initially and then came with two set of arguments.
i) Have to purchase through b*b option in their site
- the product i purchased was not available under such option but i have paid tax and i am eligible to claim credit as stated above. because of lapse in amazon system to facilitate input tax credit they denied it. when amazon facilitate collection of gst Taxes why should deny the due credit as a purchaser ?
ii) one of my email communication was replied stating to stop resale they want to deny giving gst credit.
Actually that showed real intent in some way. Anyways amazon terms & conditions state it an as a user the product cant be resold. i accept the terms & buy so they should develop mechanism to have control of it or trace such activity and also have legal opportunity if i take any commercial advantage as i violate their terms. But they showed real intent they want customer to face loss to save their lapses in system. My genuine concern wherein i use it for business/profession i am eligible for tax credit but was denied merely on speculation and to cover up of lapse in system to adapt to recent developments in the taxation - gst from VAT.
Attaching Mail (one of the several mails) i sent in detail stating i am not taking any commercial advantage through resale but was denied and i escalated it several times but was denied bluntly.

As a tax payer i paid the full amount and Amazon denied it because of lapse in system and speculation which had caused loss to me. i want full refund of denied tax credit as it is mistake of amazon not to facilitate legal benefit available.
