We purchased a MI note * Mobile handset phone on **/**/**** from authorised Xiaomi dealer in Bandra (West) for Rs.****. The Product was having manufacturing defects and therefore it was replaced by a new handset on **/**/****. The front and back panel of the cell phone was physically damaged and therefore we visited the Service center of Xiomi in Khar (West), Mumbai on **/**/****. The product was inspected by the technician at the service center and as the product was out of warranty, a service charge of Rs.****/- was quoted for changing the entire front touch panel and back panel of the Phone. We agreed to pay Rs.**** and a service order was generated. We also paid a sum of Rs.*** as advance. However, after * days we received a call from the service center that the phone has some water damage issue in the motherboard and cost for the repairing would be Rs.****.
I was surprised and shocked with this subsequent intimation by the Service Center. The price of the phone is Rs.**** and an equivalent amount for repairing was demanded by the Service Center in most illogical manner.
Our phone was functional at the time of handing over at the service center. If it was water damaged, it would have been completely dead. We strongly believe that the product is mishandled at the service center and they are grossly negligent and failed to secure and protect the mobile which was entrusted to them as bailee. It is also likely that the Service Center is dishonestly involved in defrauding innocent customers with such modus operandi. It is also amounting to wrongful loss to us and wrongful gain to Xiomi. This clearly establish unfair trade practice and deficiency in service.
The demand of revised changes is dishonest, unlawful without our fault. It makes absolutely no sense for paying the service charges which is equivalent to the cost of the new phone. I was ready to pay the charges as per service order generated and mutually agreed.
I raised complaint with the consumer complaint department of the MI, but all in vain. They have intentionally kept on repeated that my phone is out of warranty therefore i have to pay the charges. They failed to comprehend that the issue is not with respect to payment of charges, but revised charges which is being unlawfully demanded by the Service Center for the damages which is not caused by us. Copy of the Email communication is attached for ready reference.
My phone is still lying with MI service center and it contains sensitive, personal and confidential data.
I demand my phone back in good order and working condition with all my data intact and a compensation of Rs.**,*** for the damages caused to the handset, travelling cost and mental agony caused by the service center and MI Customer service department.
