Damages
That the complainant is a registered body under the Registration of Societies Act, comprising of the members who are the residents of the sector **-**, Mohali, developed by the developer – respondent “Janta Land Promoters Pvt. Limited”.
(b). That despite the fact that the Mega Project was sanctioned in the year ****, and the development of the same was started as early as in the year ****. Now almost **% to **% of the residential plots in the sector are constructed and is inhabited by more than **** families. But still the development of the sector and the basic amenities provided by the developer is far from being minimal what to say of satisfactory. The sector lacks most of the basic amenities, which are the basic needs of normal life like drinking water supply, the sanitation conditions and the roads / maintenance of roads.
(c). That, all these basic facilities are not either provided by the developer or not being maintained, despite the fact that the developer is charging an unreasonably hefty amount in the name of maintenance charges alongwith the water bills.
(d). That the residents of the sector are facing numerous problems due to this non-providing of the basic facilities or due to poor and unsatisfactory maintenance of the same on the part of the developer. Some of the difficulties / problems being faced by the sector due to the mismanagement of the developer are as under:-
(a). The water is the basic human need and every one requires the clean, potable drinking water. The residents are facing the shortage of water supply in the area when the water is not supplied at all during the full day, or the water pressure is so low that it doesn’t even reach the ground floor taps. The water which is supplied is more often than not soiled and dirty.
(b). The sewerage system of the sector is not working properly. Every second day the sewerage is blocked at one or the other place. The developer is not even running the STP for the required amount of time and without even putting the required / necessary treatment chemicals. At various places, the sewerage water is thrown into the storm water pipelines, causing bad smell in the area. This problem was even checked by the Pollution Control Board department and found many discrepancies in the same. The developer in order to save the expenditure on staff, maintenance and running cost does not run the STP at regular intervals.
(c). That despite the fact that more than ** years have passed since the project was sanctioned and allotted to the respondent-developer, still more than **% of the roads of the area, especially on the farther end of the sector have been left unfinished just waiting for the metaling job. Because of the unfinished roads the water gets clogged every here and there resulting in formation of the little ponds of stagnant filthy water. These stagnant water pits are the breeding spots for the mosquitos which are posing a serious threat to the health of the residents, who are facing high risk of the deadly disease “DENGUE”.
To add to this, the unfinished and un-metaled roads, pose another risk to the residents of getting injured in accidents. The roads are dusty and uneven which are not safe for plying the vehicles and drivers always at the verge of skidding / slipping. This is very hazardous and a serious threat to the life of the residents apart from being harmful for the vehicles. Some of the roads, although metaled yet are incomplete as the final layer has not been laid on the same. Now, most of the roads have developed potholes and either need to be repaired or recreated.
(d). There is a space in the map of the sector-** earmarked for the community center but till date the same has not been made and provided for the residents of the sector.
(e). There is a dispensary building constructed in the sector -** but the same has not been provided for the benefit of the residents and the respondent-developer is using this building for his office and for personnel use or for personnel functions.
(e). That despite the fact that the sector is densely inhabited, yet there is no direct road connectivity to and from sector ** and all the traffic has to pass through a tight road of the sector ** as a make shift arrangement.
(f). That the project of sector **-** is not being taken over by GMADA due to a default in payment by the respondent-developer.
