Ebay.In - Seller sent me an open box without mobile phone.

I had ordered an imported mi max * smartphone of price Rs.***** from eBay.in

The packet was alright from outside and there was no tampering. Inside the packet I got a box of mi max * INDIAN variant. There was no phone and charging adapter. There was only the cable and papers inside the box. I had raised this issue with eBay. But eBay took favour of it's seller by giving just an unacceptable argument. EBay told me that the weight of the package was same at all the places starting from the origin to the destination, so there cannot be any problem with the package. I wonder if eBay was there to take the weight of the package at all the places!
Since I had ordered an imported phone I asked the seller to provide me the custom clearance papers for verification. But the seller denied to provide me those papers.
Now I know that the seller is indulged in this kind of frauds and many other illegal trader practices like selling products at more price then the MRP and charging money more then the invoice price. He even does these things by openly mentioning these things on the eBay.in website. I will provide the screenshots in support of my claims also if required.
